Navigating the new Disclosure Obligations

In 2022 the Unit Titles (Strengthening Body Corporate Governance and Other Matters) Amendment Act was passed. All changes contained in the Act have now been incorporated into the Unit Titles Act and Unit Titles Regulations. The changes also significantly increased owner obligations in relation to pre-contract and pre-settlement disclosure statements. The reality is, despite these statements being the owner's obligation, it is body corporate managers who prepare them. This presentation aims to assist managers in understanding the increased disclosure obligations, in order to ensure compliance with the obligations.

Running a successful General Meeting of a Body Corporate

From the setting of the General meeting date through to the closure of the meeting there is a huge list of tasks for both the BC Manager and the Chair of the meeting to do in order to achieve and make the meeting a success. Success means closing the meeting with all resolutions dealt with either passed or lost and with owners still talking to each other. This topic will take attendees through the journey from the first Regulatory notice of the meeting, setting the agenda, and providing guidance on attending and voting at the meeting in person and virtually as per the new Evoting Regulations that will come into force on 9th May 2024, to running the meeting in a professional and controlled manner and closing the meeting off with all resolutions dealt with.
The Radical Change to a Building Warrant of Fitness (BWoFs)

Body corporate managers need to have strategies and suppliers in place to ensure that their building will still obtain a Building Warrant of Fitness (BWoF) with the introduction of Specified System Report and Declarations (S-RaDs) and BWoF Report and Declarations (BRaDs) and a changed approach if buildings inspections are missed or building systems are non-compliant. This can be complicated by tenancy fitout works, changing suppliers and redevelopments and need to be managed carefully.
